In light of today's Avandia revelations, the pharmaceutical industry's ethically ambiguous practice of using data-mining companies to track what physicians prescribe -- and then using that information to refine sales pitches and drug promotion -- seems all the more sinister.

After New Hampshire tried to ban the data mining, a federal judge declared the law unconstitutional. But twelve other states are considering similar laws.
